Privacy Policy

Effective November 5, 2026. This policy explains what we collect, why, and the choices you have.

1. Who we are

This Privacy Policy explains how PerqIQ LLC, a Wyoming limited liability company doing business as PerqIQ ("PerqIQ," "we," "us"), collects, uses, shares and protects personal information when you visit perqiq.com, use our app at app.perqiq.com or our scanner app, or hold a PerqIQ loyalty card from a business that uses our Service. It should be read with our Cookie Policy, Terms of Service and Subscription Agreement.

We act in two roles. For information about our own Customers (the businesses that sign up for PerqIQ) and website visitors, we decide how the information is used, and for users in the European Economic Area, the United Kingdom and Switzerland we are the data controller. For information about Cardholders, the people who hold a loyalty card from a business, the business is in charge of that information (the controller) and we process it on the business's behalf (the processor).

2. Information we collect

Information you provide

  • Account and contact details: name, email, company name, postal address, phone number, and login credentials.
  • Program details: loyalty card designs, offers, locations, staff and manager accounts, settings, and anything you enter in interactive features.
  • Orders and billing: plan, invoices and payment status. Payment card details are collected and stored by our payment processor, Stripe, under its own privacy policy, and not by PerqIQ.
  • Communications: support requests, forms, and messages you send us, including through social media.

Information collected automatically

  • Log data: browser type, access times, pages viewed, IP address, and the page you visited before ours.
  • Cookies and web beacons, described in our Cookie Policy.

Information from other sources

  • If you sign in with a single sign-on provider such as Google, we receive your name and email address. Depending on your settings with that provider, we may also receive other profile details. You control what is shared in your Google account settings.

About Cardholders (processed for the business)

  • Information the business or the Cardholder provides when a card is issued, which can include name, email, phone number and date of birth.
  • Loyalty activity: stamps, points, balances, rewards, coupons, gift card values, and the time and place of transactions.
  • Device and wallet details needed to deliver a card and push notifications, such as a wallet pass identifier and push token.
  • Location, only if the Cardholder allows it, to send a message when they are near a business.

3. How we use information

  • To provide, secure and improve the Service, including issuing cards, recording activity, and sending the push notifications a business has set up.
  • To create and manage accounts, process orders and payments, and send invoices, service notices and support replies.
  • To send product news and offers to businesses, where permitted.
  • To measure and analyze use of our website and Service, personalize your experience, and develop new features.
  • To prevent fraud and abuse and to comply with law.

We do not sell personal information. We use Cardholder information only to provide the Service to the business that issued the card, and we do not use it to market our own products to Cardholders.

4. Our legal bases (EEA, UK and Switzerland)

If you are in the EEA, the UK or Switzerland, we process personal information when we have a lawful reason to do so:

  • Contract: to provide the Service you asked for.
  • Consent: for example, for direct marketing or non-essential cookies, where consent is required. You can withdraw it at any time.
  • Legal obligation: for example, tax and accounting records.
  • Legitimate interests: for example, operating and securing the platform, preventing abuse, and promoting our business, balanced against your rights.

5. How we share information

  • With the business that issued a card. A Cardholder's information and activity are shared with that business.
  • With service providers who work for us under confidentiality and data-protection obligations and only as needed, such as hosting, payment processing (Stripe), email and messaging delivery, analytics, customer support and security providers, and the technology provider whose platform helps run our Service.
  • With wallet providers, such as Apple and Google, to deliver and update loyalty cards.
  • With affiliates and related companies under common ownership, for the purposes in this policy.
  • For legal reasons, to comply with law or lawful requests, enforce our agreements, or protect rights, safety and security.
  • In a business transfer, such as a merger, financing or sale of assets.
  • With your consent or at your direction.

We may also share aggregated or de-identified information that does not identify you.

6. Analytics and advertising

We may use analytics and advertising tools, which can include Google Analytics, Google Tag Manager and similar services, to understand how our website is used and to measure campaigns. These providers may collect information such as IP address, browser, pages viewed, time spent and links clicked, using cookies and device identifiers. Our Cookie Policy explains the choices you have, including how to opt out.

7. Customer personal information

When we process information on behalf of a business, we use it only to provide the Service to that business. If you are a Cardholder and want to access, correct or delete your information, please contact the business that issued your card. If you contact us, we will direct your request to the business and help it respond. For Customers in the EEA, the UK or Switzerland, we offer a Data Processing Addendum on request at legal@perqiq.com.

8. Marketing

We send marketing emails to businesses where we have a legitimate interest or, where the law requires it, with consent. You can unsubscribe using the link in each message or by contacting us. We may keep a record of your objection so that we honor it.

9. How long we keep information

We keep information for as long as an account is active and for as long afterward as we need it for legitimate interests, legal obligations (including tax and accounting records), enforcing our agreements, or resolving legal claims. After a business's account is canceled, or its trial ends without a paid plan, we hold the account data for 30 days so it can be reactivated or exported, then delete or anonymize it, except where we must keep it longer by law.

10. Security

We use reasonable physical, technical and organizational measures to protect information. No method of transmission over the internet or of electronic storage is completely secure, so we cannot guarantee absolute security. Use a strong, unique password and tell us promptly if you suspect a problem.

11. International transfers

We are based in the United States, and information is processed, transferred and stored in the United States. If you are located elsewhere, you may not have the same protections as under your local law. Where the law requires, we use approved safeguards, such as standard contractual clauses, for transfers of personal information from the EEA, the UK or Switzerland.

12. Your rights and choices

Depending on where you live, you may have the right to access, correct, delete or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent where we rely on it. To make a request, email legal@perqiq.com. We may need to verify your identity. If you are in the EEA, the UK or Switzerland, you may also lodge a complaint with your local data protection authority.

  • You can update account information by logging in or by emailing us, and ask us to deactivate your account.
  • You can limit cookies in your browser settings, which may affect how the site works.
  • You can opt out of promotional emails using the link in them. We will still send service and account messages.

13. Children

The Service is for businesses and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we will delete it.

14. Links to other sites

Our website and cards may link to websites and services we do not control. We are not responsible for their content or privacy practices, so please review their policies.

15. Changes to this policy

We may update this policy from time to time. We will post the updated version with a new effective date and, where appropriate, notify account holders of material changes.
